Terms and Conditions

1. Domain Names

One free domain name is included in your monthly fee. This includes .com, .org, .net, .co.nz, org.nz, .net.nz top level domains.  If you have a domain already we can use this for your new SCM site.  For information regarding domain names and cancellations, see section 6.

2. Disk Space

Each SCM account is allocated approximately 200MB of disk space. If your usage is above this, and negatively impacting on other users of our system, then we will contact you to investigate whether alternative arrangements need to be made. Please note that email counts towards your total disk space usage.

3. Data Usage

Each SCM account is allocated 1GB of international data transfer (also known as bandwidth) per calendar month. If your bandwidth usage is negatively impacting on other users we will contact you to investigate whether alternative arrangements need to be made.

4. Email Addresses

Each SCM account includes up to 5 free email addresses for its domain.  The domain must be administered by Turboweb and have the MX record controlled by Turboweb.  Each account is limited to 200MB of storage.  The storage for any email address may be increased at any time on request (additional charges apply).  Additional email addresses may be added at any time on request (additional charges apply).

5. Upgrades

No charge is made for upgrades and they are automatically applied to each SCM account as they become available.  This may result in occasional brief outages.  Turboweb will make best efforts to ensure that any outages are kept to a minimum and during times that are less likely to affect visitors to your website.

6. Cancellation

Cancellation can be made at any time and any paid unused full months will be refunded. Where cancellation is made within the first month a $39.95(NZD) charge will be made for the domain name if registered by Turboweb Limited and the UDAI will be sent to the account holder allowing transfer to another provider.

7. Acceptable Content

Pornography or hate content are completely unacceptable. Turboweb will be the sole arbiter as to what constitutes a violation of this provision.

8. Refusal of Service

Turboweb Limited reserve the right to refuse, cancel, or suspend service at our sole discretion.

9. SCM Publicity Scheme

Turboweb Limited may publicly display the name, web address (URL) and a screenshot of your website in order to promote the SCM service.  At no time will any private information about your website be disclosed.  You may choose to opt out of the SCM publicity scheme by contacting Turboweb.  We will not aggregate information about your website in such a way that would negatively impact on your website.

10. Changes to the Terms and Conditions

These terms and conditions may be modified at any time and without notice. All users previous and new are always subject to the newest terms posted here at all times.

IN NO EVENT WILL TURBOWEB BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE TURBOWEB SERVICES OR ANY CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY ANY FAILURE OF PERFORMANCE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION; COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.
